Our web hosting provider is an Internet Presence Provider. They host web pages and provide e-mail services. Our web hosting provider has certain legal and ethical responsibilities regarding the use of its computer network and equipment involved in these services.
It is their goal to be unbiased in providing hosting services for the World Wide Web. However, our web hosting provider reserves the right to cancel or interrupt any client's access to their services if they believe the account is abused.
Unacceptable Use Policies
Unsolicited commercial E-mail
Any unsolicited e-mail is considered "spamming" and may result in your account suspension or cancellation. Spamming or unsolicited e-mail is frowned upon in the industry and in most cases considered "unethical". E-mail is meant to be person to person or one party to an agreeable second party.
Adult & Non Acceptable Material
No Nudity, Pornography, "unethical" or other "Adult" related material of any kind is to be stored on their servers or referenced from their servers. Our web hosting provider reserves the right to determine what is or is not "ethical" in this matter.
Cancellation
Cancellation may occur at anytime and be invoked by the customer or by our web hosting provider. They reserve the right to cancel hosting services at anytime. Any cancellation by the customer must be in writing and sent via snail mail. Our web hosting provider will notify the customer of cancellation only via e-mail. If cancellation is due to your abuse of this policy, there will be no refunds.
Legalese
Our web hosting provider requires all use by customers or Resellers be of a lawful purpose only. They reserve the right to refuse service at anytime to anyone for any reason. Use of our web hosting provider's servers or bandwidth in violation of any Federal, State or Local, statute laws or regulation is prohibited and constitutes grounds for cancellation. Our web hosting provider does not allow any adult material of any nature. They do not allow sub-hosting of any kind. Any violation of the above will result in a warning of violation. If the violation is not ceased immediately the lack of action will be grounds for termination of your account.Our web hosting provider's services are intended for the enduser only. Customers cannot sublease, subhost, or give away control of any portion of our web hosting provider's resources. Doing so could result in immediate account cancellation.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold our web hosting provider harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney fees asserted against our web hosting provider, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless our web hosting provider against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with our web hosting provider's server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from our web hosting provider's server.

Our web hosting provider will not be responsible for any damages your business may suffer. Our web hosting provider makes no warranties of any kind, expressed or implied for services they provide. Our web hosting provider disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by our web hosting provider and its employees. Our web hosting provider reserves the right to revise its policies at any time.
